2. Scope of Application

These Terms and Conditions (AGB) apply to all contracts concluded via the online shop Green Dragon Shop between the seller and consumers (B2C) within Germany.
The offer of this shop is directed exclusively to persons of legal age residing in Germany.


3. Conclusion of Contract

  1. The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order (invitatio ad offerendum).

  2. A sales contract is concluded only when the seller confirms the customer’s order by e-mail or dispatches the goods.

  3. In case of system errors, price inaccuracies, or product unavailability, the seller reserves the right to refuse order processing. The customer will be informed immediately, and any payments made will be refunded.


4. Prices and Payment

  1. All prices are stated in euros (EUR) and include VAT (gross prices).

  2. Accepted payment methods: Paytriot and Direct Bank Transfer (including card payments, bank transfers, and other options provided by these payment systems).

  3. Payment is due immediately after placing the order, according to the terms and conditions of the selected payment provider.


5. Delivery and Processing Time

  1. Deliveries are made exclusively within Germany via DHL.

  2. The standard delivery time is 1 to 3 business days, with a maximum of 5 business days after payment confirmation.

  3. Customers receive a tracking number to monitor the delivery status.

  4. If a different delivery time is stated for a specific product, that time applies.

  5. If an item is temporarily unavailable, the customer will be informed by e-mail about the expected delivery time or offered a refund.


6. Right of Withdrawal

Consumers have the right to withdraw from the contract within 14 days without providing any reason.

“Right of Withdrawal”, available on the shop’s website and provided via e-mail after the order is placed.

Exclusions from the Right of Withdrawal:

The right of withdrawal does not apply to:

  • sealed goods that are not suitable for return for health or hygiene reasons once unsealed (e.g. filters, mouthpieces, used or contaminated accessories);

  • goods made to the customer’s specifications or clearly personalized;

  • goods that have been used, damaged, or otherwise altered after delivery.


7. Warranty and Complaints

  1. The seller is liable for product defects in accordance with §§ 434 et seq. of the German Civil Code (BGB).

  2. The statutory warranty period is 2 years from the date of delivery to the consumer.

  3. Consumers are kindly requested to report any visible transport damages within 14 days of receiving the goods so the seller can submit a claim to the shipping company.
    Failure to report such damages does not affect the customer’s statutory rights.

  4. Complaints can be submitted via e-mail to [email protected] or through the contact form available on the website.


8. Retention of Title

The goods remain the property of the seller until full payment has been received.
Until ownership has transferred, the goods may not be pledged, resold, or otherwise transferred to third parties without the seller’s consent.


9. Limitation of Liability

  1. The seller is liable only for damages caused intentionally or through gross negligence.

  2. Liability for minor negligence is excluded unless it involves injury to life, body, health, or breach of essential contractual obligations.

  3. In all cases, liability is limited to foreseeable, typical damages.

  4. Statutory warranty rights remain unaffected.


10. Applicable Law and Contract Language

  1. All agreements between the seller and the customer are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

  2. The place of performance for all contractual obligations is the seller’s registered address.

  3. The contract language is German.
    In the event of discrepancies between translations, the German version shall prevail.


11. Severability Clause

If any provision of these Terms and Conditions is or becomes invalid or unenforceable, the remaining provisions shall remain in full force and effect.
The invalid provision shall be replaced by a valid one that best achieves the intended economic purpose of the original clause.


12. Changes to the Terms & Conditions

The seller reserves the right to modify these Terms and Conditions for valid reasons, in particular due to:

  • changes in applicable legislation,

  • adjustments to shop functionality, payment methods, or product offerings.

Customers will be notified of any changes at least 14 days before they take effect.
The updated Terms will apply only to orders placed after the effective date.


13. Data Protection

 

The protection of customer data is handled in accordance with the General Data Protection Regulation (GDPR) and the shop’s Privacy Policy, available on the website.
